In a unanimous decision, the U.S. Court of Appeals for the Third Circuit upheld a lower-court ruling that President Donald J. Trump’s July appointment of Alina Habba, his former personal attorney, as acting U.S. attorney for the District of New Jersey was unlawful. The panel concluded that Habba was ineligible to serve in the role and noted that other recent appointments by the Trump administration also violated federal law.
Among them was Lindsey Halligan, whom a judge found last month had been improperly installed as interim U.S. attorney for the Eastern District of Virginia, prompting the dismissal of cases she brought against former F.B.I. director James Comey and New York Attorney General Letitia James.
